ASSOCIATIVE MOVEMENT

Since the origins of associative movement, SCA has contributed directly and in an ongoing manner, to the legal development of the integration of disabled individuals, especially the intellectually disabled, by offering advising with regards to the Plena Inclusión (Full Inclusion) movement. Since its onset, this associative movement has supported, managed and offered legal solutions to all social movements or initiatives with which it has been associated, providing support, promotion and development for the disabled.

LABOUR LAW LITIGATION

SCA handles the overall procedural defense of clients in all contentious issues within the social branch of the law, both in social jurisdiction as well as before administrative authorities having competence in this area, especially before the Labour Inspectorate and mediation and arbitration organisms. It intervenes in all types of legal procedures, across the country, having extensive experience in the area, both in individual and collective processes before the Social Courts, National Audience, Supreme Courts of Justice and Constitutional Court; the firm has also intervened in processes before the Court of Justice of the European Communities.

In addition to the personal defense of the issue, we fully develop the litigation: from its creation, adopting the caveats of conflict prevention, as well as, once filed, the approach, preparation and development of the procedure in all of its phases, in the first instance and any resulting appeals, depending on the specific case.

LABOUR INCLUSION

SCA is a qualified specialist in the area of disability, in the policy and conventional development of a legal framework that is intended to ensure labour and social equality for disabled individuals through distinct forms of labour integration: protected employment, labour enclaves, ordinary employment, reservation quotas, etc.; its commitment and dedication to the sector (through the advising of associative employer organizations (federations and confederations) and entities) has led to the contribution or advancing of this objective of full individual inclusion, the progressive implementation of Human Rights Law for these individuals and their recognition as citizens with equal rights.

RELATIONS WITH THE ADMINISTRATION

In this context, and with regards to the organizations working in the area of disabilities, relationships with public administrations are essential; legally speaking, SCA offers broad experience in this area, especially with regards to subsidy dossiers, expenditure justifications, programs, etc., being highly successful in both the administrative channels as well as with contentious-administrative jurisdiction, in reimbursement files and similar documents.

COLLECTIVE BARGAINING

SCA offers advising on the creation of collective labour relationships in the company, both regarding obligations derived from the worker representative election processes, as well as in the relationships and dialogue with unitary and labour union representatives. The firm relies on its extensive knowledge and experience in the collective facet of labour law: social dialogue, trade union relations, collective conflicts and strikes; so, for years now, it has directly participated in collective bargaining procedures, both regarding company agreements and in statutory collective agreements of a sectorial nature (national, regional and provincial), of companies, company groups and, more recently, the so-called network partnership conventions.

INDIVIDUALS AND DEPENDENCY

Along with the organizational, public and employment areas, the firm also handles private individual issues, their development and legal protection in the area of civil defense (incapacitation, guardianship, limitations of capacity, right to vote, etc.); in the area of care, from the recognition of the situation of dependency to the declaration of incapacity or professional retirement (retirement pension, compatibility with other pensions, premature aging and labour performance, etc.).

Likewise, it offers specific assessment regarding individual protection measures and future anticipation, for times when family members are no longer here, so as to leave the disabled individuals with a level of protection that is appropriate for their specific case, through preventive measures to be established through executors, with specific contracts to be underwritten by the family members taking care of them, especially protected patrimony, etc.

COMPANY RESTRUCTURING

Human resources policy requires a sufficient degree of legal security when considering company feasibility needs. SCA offers advising on an on-going basis, regarding the configuration of necessary measures, anticipating solutions that may prevent future collective measures and managing the process that may be necessary in all of its phases: entrusting us with the overall design of the same, both in document preparation, negotiation and final resolution, as well as, when relevant, its legal defense. These procedures affect the so-called internal flexibility (modification of conditions, removal or failure to apply the agreement, geographical and functional mobility, transfer of productive units, outsourcing, etc.) as well as the outgoing flexibility (collective redundancies, plural or individual).

Desde sus orígenes el despacho ha estado muy vinculado con el mundo universitario; hoy en día se manifiesta especialmente a través de su socio-director que compatibiliza su actividad profesional con la docencia y la investigación en la Universidad Pontificia de Comillas-ICADE, tanto en Grado como en Master o Postgrado.

Esta vocación hace que el despacho participe constantemente en actividades docentes y formativas: desde ponencias y participaciones en mesas redondas en congresos y similares a la organización específica de eventos formativos ad hoc para empresas, a sus empleados o a otras organizaciones que puedan estar interesadas en una formación especializada sobre las materias caracterizadoras del despacho (las formaciones más demandadas son en materia de derecho laboral y discapacidad)
